You must also show the Guatemalan government is unable or unwilling to protect you. Evidence of individual targeting — specific threats, physical violence, harm to family members — is critical to distinguish your claim from general crime in Guatemala. Yes, strong claims are available for Venezuelan political activists and opposition-affiliated individuals. Political opinion — specifically opposition to the Maduro government or membership in opposition parties — has been recognized as a protected ground by many immigration judges. The strength of your claim increases significantly if you have evidence of: direct government targeting (arrest, detention, interrogation, threats from SEBIN or FAES), prior political activity that is publicly documented (opposition party membership, protest participation, journalism, union activism), or persecution of your immediate family members. Even absent direct personal targeting, country conditions for Venezuela are so severe that a well-founded fear claim based on visible political activity can succeed. Missing the 1-year deadline bars you from asylum but does not bar withholding of removal or Convention Against Torture (CAT) protection. Withholding requires proving that it is more likely than not — over 50% probability — that you would face persecution on account of race, religion, nationality, political opinion, or particular social group membership. CAT requires proving it is more likely than not you would be tortured with government acquiescence. Both forms of protection prevent deportation to your home country but do not provide a path to a green card. Exceptions to the 1-year deadline include changed circumstances (change in country conditions or your personal situation after arrival) and extraordinary circumstances (serious illness, legal disability, ineffective assistance of prior counsel). Westchester County removal cases are heard at the New York Immigration Court at 26 Federal Plaza, Room 1237, New York, NY 10278. Your NTA should specify the court location. Master calendar hearings (initial hearings) and individual merits hearings (full asylum hearings) are both held at 26 Federal Plaza. If you are detained, you may be transferred to a detention facility and appear at a different immigration court.
