If you entered without inspection and have no qualifying family petition, your options are limited but not zero. If you have U.S. citizen children under 21 who could petition for you when they turn 21, planning ahead for consular processing with an I-601A waiver may be the best path. If you have been in the U.S. for 10 years and are placed in removal proceedings, cancellation of removal may apply if you have U.S. citizen or LPR family who would suffer exceptional hardship. If you fled persecution in Guatemala, a defensive asylum claim in removal proceedings may also be available. A comprehensive consultation will map all possible pathways based on your specific situation.
Yes. The I-601A provisional unlawful presence waiver is available to qualifying individuals regardless of nationality, provided they have accumulated unlawful presence in the U.S. and have a U.S. citizen or LPR spouse or parent who would suffer extreme hardship if they were denied the visa. After approval of the I-601A, you depart for consular processing at the U.S. Embassy in Guatemala City. The I-601A only waives unlawful presence — if you have other grounds of inadmissibility (such as prior removal orders or misrepresentation), additional waivers or procedures may be required. We evaluate the full picture before any filing.
